Whirlpool Defective Refrigerator Litigation
Chimicles & Tikellis LLP filed a class action complaint in the Northern District of Ohio against Whirlpool Corporation (“Whirlpool”) on behalf of consumers who purchased defective side-by-side refrigerators manufactured or sold by Whirlpool at any time between 2000 and the present (the “Refrigerators”).
The complaint alleges that the ice chutes in the Refrigerators suffer from a design flaw and/or manufacturing defect. The ice chute is a rectangular unit on the exterior of the Refrigerators (often situated on the outside of the freezer door), and, when working properly, is supposed to provide a convenient source for drinking water and crushed or cubed ice. The complaint alleges that the ice chutes on the Refrigerators are defective because, among other reasons, they are predisposed to clogging and freezing completely solid. When the ice chutes in the Refrigerators are frozen solid they are inoperable and, once the ice inside of the cute melts, it leaves unsightly and difficult to remove streaks of water on the stainless steel exterior of the refrigerator, according to the complaint. The complaint further alleges that Whirlpool is and has been aware of this problem with the ice chutes on its Refrigerators, but never disclosed the existence of this defect to consumers.
The class action complaint filed by Chimicles & Tikellis asserts claims for violations of the Ohio Consumer Sales Practices Act, breach of express warranty, breach of the implied warranty of merchantability, breach of implied warranty in tort, and unjust enrichment. The complaint seeks monetary damages, injunctive relief, and attorney's fees and costs.
